As the judge saw it, Gus is a four-year-old boy conceived via artificial insemination using Patric\u2019s sperm to impregnate Danielle Schreiber, his ex-girlfriend.<\/p>\n<p>The couple, together for nearly a decade, encountered their periodic breakups.<\/p>\n<p>Nevertheless, after Gus was born, Patric and Schreiber raised Gus for more than a year together.\u00a0 Since that time, they parted ways for good.<\/p>\n<p>After calling it quits, it appears Patric wasn\u2019t prepared for Schreiber\u2019s refusal to see Gus.\u00a0 Patric has maintained and fought that he\u2019s not only Gus\u2019 biological father, but a true father in every way.<\/p>\n<p>Correspondent of <a href=\"http:\/\/abcnews.go.com\/US\/lost-boys-actor-jason-patric-takes-custody-battle\/story?id=23635740\">Good Morning America<\/a>, Cecilia Vega reports, <i>\u201cPatric has ammunition which includes forms he signed at the sperm clinic promising \u2018an intent to parent.\u2019\u201d <\/i>She continued,<i> \u201cHe is seeking full custody.\u201d<\/i><\/p>\n<p><i><\/i>On the flipside, in the same article it reads, <i>\u201cIn a statement to ABC News, Schreiber said Patric offered to donate sperm after the two broke up \u2018under the express condition\u2019 that it be kept secret and \u2018that he would not be a father to or have any obligations, rights or responsibilities for my child.\u2019\u201d<\/i><\/p>\n<p>Schreiber and her legal team also have let the courts know that Patric did not sign Gus\u2019 birth certificate.<\/p>\n<p>Now, let\u2019s rewind back to last February when the legal battle encountered its first huge stumbling block.<\/p>\n<p>Co-authors Snejana Farberov and James Gordon of <a href=\"http:\/\/www.dailymail.co.uk\/news\/article-2628593\/Jason-Patric-win-appeal-legally-recognized-father-son.html\">The Daily Mail<\/a> reminded readers in its recent article, \u201c<i>the actor lost a court battle to gain visitation rights with Gus under a California law that grants the mother full custody in the absence of a written agreement establishing parental rights.\u201d<\/i><\/p>\n<p>Since this Los Angeles Superior Court ruling, Patric has not seen Gus for more than a year.<\/p>\n<p>Remember earlier when I mentioned what a difference a year makes?\u00a0 Well, it did.\u00a0 The tide has turned in Patric\u2019s direction since the trial reversal last week.<\/p>\n<p>The co-authors continued, \u201c<i>California appeals court judge Thomas Willhite says that the presumption against in-vitro fathers shouldn\u2019t be \u2018so categorical,\u2019 and that the family law code \u2018does not preclude a donor from establishing that he is a presumed father.\u2019\u201d<\/i><\/p>\n<p>Am I surprised of this reversal?\u00a0 Not really.
