You may click the link to switch the active language.<\/p><p><span style=\"font-weight: 400;\">A recent announcement from the U.S. State Department is cause for celebration for many parents and parents-to-be. Under a new policy, children born outside of the U.S. to married, American parents, when the children are born through assisted reproductive means like in vitro fertilization and surrogacy, will now be considered U.S. citizens. At least one of the parents must be a U.S. citizen, the couple must be married to each other, and the child must have a biological tie to at least one of the parents, in order to receive automatic citizenship under the new policy.<\/span><\/p>\n<p><img loading=\"lazy\" decoding=\"async\" class=\"alignnone size-medium wp-image-2716 alignright\" src=\"https:\/\/surrogacy-lawyer.com\/wp-content\/uploads\/2021\/06\/Depositphotos_22353557_s-2019-300x200.jpg\" alt=\"\" width=\"300\" height=\"200\" srcset=\"https:\/\/surrogacy-lawyer.com\/wp-content\/uploads\/2021\/06\/Depositphotos_22353557_s-2019-300x200.jpg 300w, https:\/\/surrogacy-lawyer.com\/wp-content\/uploads\/2021\/06\/Depositphotos_22353557_s-2019-768x512.jpg 768w, https:\/\/surrogacy-lawyer.com\/wp-content\/uploads\/2021\/06\/Depositphotos_22353557_s-2019-219x146.jpg 219w, https:\/\/surrogacy-lawyer.com\/wp-content\/uploads\/2021\/06\/Depositphotos_22353557_s-2019-50x33.jpg 50w, https:\/\/surrogacy-lawyer.com\/wp-content\/uploads\/2021\/06\/Depositphotos_22353557_s-2019-112x75.jpg 112w, https:\/\/surrogacy-lawyer.com\/wp-content\/uploads\/2021\/06\/Depositphotos_22353557_s-2019.jpg 1000w\" sizes=\"auto, (max-width:767px) 300px, 300px\" \/><span style=\"font-weight: 400;\">Under the previous standards, <\/span><a href=\"https:\/\/surrogacy-lawyer.com\/our-services\/surrogacy\/\"><span style=\"font-weight: 400;\">children born via surrogacy <\/span><\/a><span style=\"font-weight: 400;\">outside the country were considered to be born out of wedlock, even when the child\u2019s parents were married to each other. The requirement that at least one parent be genetically-related to the child is not new, however. Several same-sex parents had filed suit against the State Department, asking for citizenship for their children born via surrogacy abroad. As we shared in a <\/span><a href=\"https:\/\/surrogacy-lawyer.com\/lgbt\/us-state-department-drops-two-cases-involving-citizenship-of-children-from-same-sex-couples\/\"><span style=\"font-weight: 400;\">previous blog post,<\/span><\/a><span style=\"font-weight: 400;\"> the Trump Administration\u2019s State Department ultimately dropped their appeals of court rulings favoring same-sex couples, awarding their children U.S. citizenship.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">This policy change is a win for any married couple wanting to work with a surrogate outside the U.S. to start or add to their families, but particularly so for LGBTQ+ families, against whom the previous policy seemed to discriminate.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">NPR reports that Aaron Morris, the Executive Director of Immigration Equality, an LGBTQ immigration-rights organization, summed up the ruling as affirming their organization\u2019s efforts to overturn the unconstitutional policy, saying \u201cIt demonstrates that when our community is united and relentlessly pushes back against discrimination, we win.
