You may click the link to switch the active language.<\/p><p><span style=\"font-weight: 400;\">Children born to U.S. citizens have traditionally been considered citizens themselves, regardless of where they were born. However, a Georgia couple had to fight for a legal ruling that their daughter, born in England via surrogacy, was in fact a U.S. citizen. U.S. District Judge Michael Brown ruled in the couple\u2019s favor, finding that it was unnecessary for the child to be biologically related to both of her parents in order to obtain citizenship.<\/span><\/p>\n<p><img loading=\"lazy\" decoding=\"async\" class=\"alignnone size-medium wp-image-2009 alignright\" src=\"https:\/\/surrogacy-lawyer.com\/wp-content\/uploads\/2020\/09\/Depositphotos_5369539_s-2019-300x200.jpg\" alt=\"\" width=\"300\" height=\"200\" srcset=\"https:\/\/surrogacy-lawyer.com\/wp-content\/uploads\/2020\/09\/Depositphotos_5369539_s-2019-300x200.jpg 300w, https:\/\/surrogacy-lawyer.com\/wp-content\/uploads\/2020\/09\/Depositphotos_5369539_s-2019-768x512.jpg 768w, https:\/\/surrogacy-lawyer.com\/wp-content\/uploads\/2020\/09\/Depositphotos_5369539_s-2019-219x146.jpg 219w, https:\/\/surrogacy-lawyer.com\/wp-content\/uploads\/2020\/09\/Depositphotos_5369539_s-2019-50x33.jpg 50w, https:\/\/surrogacy-lawyer.com\/wp-content\/uploads\/2020\/09\/Depositphotos_5369539_s-2019-112x75.jpg 112w, https:\/\/surrogacy-lawyer.com\/wp-content\/uploads\/2020\/09\/Depositphotos_5369539_s-2019.jpg 1000w\" sizes=\"auto, (max-width:767px) 300px, 300px\" \/><\/p>\n<p><span style=\"font-weight: 400;\">Simone was born in 2018, a full three years after her parents \u2013 both U.S. citizens themselves \u2013 were legally married. However, when the men applied for a Social Security number for their daughter, the U.S. State Department took the position that because Simone was only biologically related to one of her parents, that she was born outside the marriage. Because Simone\u2019s biological father had not lived in the U.S. for a full five years leading up to her birth, the State Department claimed that she was not eligible for citizenship.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Her parents filed suit alleging that the State Department\u2019s policy was discriminatory against same-sex married couples who cannot both be biological parents to their children. This Atlanta judge\u2019s ruling in Simone\u2019s (and her parents\u2019) favor is the second ruling this summer against the State Department\u2019s policy, as <\/span><a href=\"https:\/\/surrogacy-lawyer.com\/surrogacy-law\/trump-administration-appeals-same-sex-couples-daughters-american-citizenship\/\"><span style=\"font-weight: 400;\">previously shared on our blog<\/span><\/a><span style=\"font-weight: 400;\">. Of course, it is possible that the State Department will appeal this decision, as it has similar rulings in other jurisdictions.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">When asked for a comment on this Georgia ruling, White House Press Secretary Kayleigh McEnany stated that this ruling had to do with surrogacy and denied that the sexual orientation of Simone\u2019s parents had any impact in the State Department\u2019s policy or the judge\u2019s ruling.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The Surrogacy Law Center will continue to monitor this case and others like it, including those that are currently before appellate court judges.
